General terms and conditions of sale Itemlocator

Article 1: Field of application
1.1 The legal relationship between the parties is, unless there is another agreement, settled by these general terms and conditions of sale, of which the consumer declares having taken notice before concluding the agreement.
1.2 These general terms and conditions are only applicable to the sales agreements which are concluded through the internet between Itemlocator and the consumers.
1.3 A consumer is in the case of these general terms and conditions of sale defined as each natural person or legal person who acquires or uses products that have been put on the market only for non-professional ends.

Article 2: Establishment of the agreement
2.1 The agreement between Itemlocator and the consumer can only come about after a written confirmation of the consumer’s order by Itemlocator.
2.2 The order confirmation will be sent by Itemlocator by electronic mail at most five days after having received the payment of the electronic invoice amount (purchase price, annual membership fee and the shipping costs) to the account number KBC 734-0224867-30. This invoice has to be paid to the Itemlocator seat within five days after sending.

Article 3: Delivery of the ordered bearers of the unique owner’s code.
3.1 By entering into agreement, Itemlocator commits itself to sending the ordered bearers of the unique owner’s code within 7 days after having received the order confirmation.

Article 4: Membership
4.1 After concluding the agreement, the consumer receives the ordered bearers of the unique owner’s code from Itemlocator.
4.2 By activating the code on www.itemlocator.be the consumer obtains a one year’s membership to Itemlocator and he can enjoy the services that come with this membership.
4.3 The membership will be prolonged annually (on the renewal date of the membership) without preceding notification for the period of one year, in case the consumer does not give notice at least 20 days before the renewal date of the membership. 4.4 The annual membership fee amounts to 4.5 EUR (VAT included) and has to be paid to account number KBC 734-0224867-30 within 5 days after sending the invoice to the consumer.

Article 5: Obligation of the parties bound to the membership
5.1 Itemlocator only allocates one owner per unique owner code. The owner is the person whose e-mail address (which has been entered during the activation of the code) is linked to the unique owner’s code in the Itemlocator database.
5.2 The owner will keep Itemlocator informed about any changes of his e-mail address.
5.3 Itemlocator will act as an intermediary between the finder and the owner of bearers of the unique owner’s codes.
5.4 If Itemlocator is contacted by the finder of a bearer of the unique owner’s code, Itemlocator will make an appointment with the finder to return the bearer.
5.5 As soon as Itemlocator has regained the bearer of the unique owner’s code, Itemlocator will immediately contact the owner to return the bearer.
5.6 The owner and the finder will have no contact with each other.
5.7 The services to which Itemlocator commits itself, will be suspended during the period between the expiration of the membership invoice and the settlement of this invoice.

Article 6: Guarantee
6.1 The application or bearing of the unique owner’s code (in which ever form it may be) offers no guarantee at all to actually retrieving the lost item. It is only a tool to increase the chance of retrieving the lost item.
6.2 If the text on the bearer of the unique owner’s code is no longer legible, this bearer can be replaced at cost price. Itemlocator is not responsible for the consequences of the illegibility of the text on the bearer of the unique owner’s code.


Article 7: Privacy
7.1 The act of 8 December 1992 concerning safeguarding personal privacy and handling personal details is applicable to the information which is exchanged and gathered within the framework of this agreement.
7.2 The stored e-mail addresses will only be used by Itemlocator to keep the owners informed about new developments and innovations. The e-mail addresses will not be used for advertising purposes. The database will neither be passed on for marketing purposes.
7.3 Only the name and the e-mail address of the owner will be included in the database to ensure the privacy of the owner.

Article 8: Liability
8.1 Itemlocator is only liable for the damage resulting from this agreement which is the consequence of fraud or a serious mistake.
8.2 Itemlocator has an external operator which maintains the website www.itemlocator.be . Itemlocator is not responsible for a possible breakdown of the website or in case the website and its confidential data is hacked.

Article 9: End of the agreement
9.1 The consumer has the right to announce to Itemlocator that he will not buy anything, without having to pay a fine and without having to mention a reason, within 7 working days from the day after the delivery of the ordered bearers of the unique owner’s code. Within this period the ordered bearers have to be sent back by the consumer. The shipping costs are at the expense of the consumer. No later than 30 days after the abandonment by the customer, the amounts that the consumer had already paid will be paid back.
9.2 After the first tacit renewal the consumer can cancel the subscription at any moment and without having to pay a fine with due regard of a term of notice of one month. The membership fee of the current year which has already been paid remains definitively acquired by Itemlocator.
9.3 Itemlocator can cancel the subscription at any time and without having to pay a fine if the consumer fails to comply with one or more of his contractual obligations.

Article 10: Unity of the agreement
10.1 The possible invalidity of one of the stipulations of this agreement will have no influence at all on the validity of the other stipulations despite the invalidity of the stipulation of dispute. The parties will make every effort to replace the invalid stipulation in mutual accordance by a valid stipulation with the same or largely the same economic impact as the invalid stipulation.

Article 11: Governing law and competence
11.1 Exclusively Belgian law is applicable to this agreement.
11.2 In case of dispute, it is exclusively the court of law of the judicial district of Antwerp which is competent.
